La teoría “coaseana” del derecho, y el Análisis Económico del Derecho en general, asumen implícitamente la veracidad de dos premisas comportamentales: la “exogeneidad de la preferencia” y la “independencia de la referencia”. Este artículo señala algunas objeciones a estas premisas, luego evidencia algunas implicaciones acerca de: cómo el AED –desde un punto de vista positivo– pronostica los comportamientos de las personas y los efectos de las normas jurídicas entendidas como incentivos, y cómo, –desde un punto de vista normativo– la teoría (...) económica sugiere las decisiones del juez o del legislador. El artículo además presenta los desafíos a los que se enfrenta el AED al aceptarse la premisa comportamental de que las personas valoran los derechos individuales, no en términos absolutos, sino en términos relativos, comparados con un punto de referencia. Though it is legally permissible to kill combatants in war,unless they are rendered hors de combat,the existence of Naked Soldiers raises an important moral question: should combatants kill vulnerable enemy combatants or show mercy towards them? Most philosophers who address this question argue that it is morally permissible to kill the Naked Soldier given the extended notion of self-defense during war. They ground their arguments in a form of collectivism. In this essay, I use Larry May’s argument. He offers an (...) approach that extends the principle of discrimination that would also apply to combatants. Instead of assuming all combatants are de facto dangerous,this approach would allow for nuance in targeting the enemy and showing mercy when enemy combatants clearly pose no danger, in other words, when they are Naked Soldiers. I defend this view against two criticisms: Noam Zohar’s view of armies as complex collectives and Stephen Deakin’s view that a policy that spares Naked Soldiers would be open to abuse. I argue that it is not only morally suspect to kill Naked Soldiers, but also it is within the spirit of both international laws governing war and the just war tradition to offer mercy whenever possible. In war there is a phenomenon known as the Naked Soldier problem (NS). A combatant discovers a vulnerable enemy combatant who is unable to defend himself and usually unaware of the combatant’s presence. This enemy combatant is not presently engaged in fighting and not threatening the lives of others. While killing the NS is legally permissible, the question I address in this essay is whether or not there can be a moral justification for doing so. I think such a moral (...) justification is lacking, and there are only excuses for killing the NS. In this essay, I distinguish between a justification and an excuse and then I examine four traditional reasons given for the acceptability of killing in war to see if any of them are (a) justifications for killing in war in general and (b) justifications for killing the Naked Soldier, specifically. The recent nationalist movements in liberal democratic states such as the US, the UK, and Germany have been related to xenophobia. The rise of Trumpism brands Muslims and Mexicans as outsiders, while part of the motivation behind Brexit was animosity towards non-Britons like Poles and Muslims. The question is how are nationalism and xenophobia related. According to Ronald Sundstrom, nationalism shelters xenophobia by creating obstacles that prevent immigrants and refugees from attaining a sense of civic belonging. He uses the metaphor (...) of sheltering to suggest that xenophobia becomes a byproduct of nationalism in the right conditions. I think this is a misunderstanding of the relationship between nationalism and xenophobia. In this essay, I do three things: first, I articulate Sundstrom’s argument explaining how each of the three obstacles works to produce an environment of xenophobia; then I consider what reforms might look like, yet these reforms would no longer leave us with something that we can recognize as nationalism; lastly, I argue that nationalism just is the modern day manifestation of xenophobia and so they are inseparable social phenomena. AbstractIn many cultures, interactions between humans and plants are rooted in what is called “relational values”—values that derive from relationships and entail reciprocity. In Mexico, biocultural diversity is mirrored in the knowledge and use of some 6500 plant species and the domestication of over 250 Mesoamerican native crop species. This research explores how different sets of values are attributed to plants and how these influence management strategies to maintain plant resources in wild and anthropogenic environments. We ran workshops in two (...) communities in a highly biodiverse region in western Mexico, to ascertain the values and management activities related to important plant resources. The relationship between values attributed to plants and management activities was examined through redundancy analysis. A total of 180 plant resources were mentioned during the workshops, with a broad spectrum of values attributed to them, including material, non-material, and regulatory dimensions. We divided plant management strategies into three general categories of increasing intensity and complexity. We found that participants in the Indigenous community value and manage more wild plant resources than people in the non-Indigenous community. We also identified relationships between plant resource values and the type of management performed; for example, more intensive forms of management, such as sowing seeds, were used for seasonal plants that had a food value. By valuing and managing different sets of plant resources from forest, agricultural plots, and home gardens, people enabled multi-functional landscapes to form, illustrating a key feature of relational values in agroecosystems, which promotes both conservation and domestication of plants. The study examines the perception that students have of an establishment in the commune of Osorno, about the formation processes and the interpersonal relationships that exist in their school development. The sample is made up of 157 high school students. To achieve the purposes, a survey-type instrument is designed and validated, containing alternatives. The results show that the students consider that their learning process has been positive. They report that the tasks are excessive and the subjects difficult, but they indicate (...) that their teachers know how to explain the same content differently, they are patient, they motivate them to learn. They report that in school they learn and that teachers propose interesting topics in the classes. (shrink)

Using a countable support product of creature forcing posets, we show that consistently, for uncountably many different functions the associated Yorioka ideals’ uniformity numbers can be pairwise different. In addition we show that, in the same forcing extension, for two other types of simple cardinal characteristics parametrised by reals, for uncountably many parameters the corresponding cardinals are pairwise different.

This article analyzes the repercussions of G. Politzer’s thought on the philosophy of life elaborated by G. Canguilhem. During the first thirty years of the twentieth century, Politzer’s texts provide important material for the construction of the philosophy that Canguilhem builds on human individuality and its autonomy. The reading of Politzer constitutes for Canguilhem a motive of inspiration for his axiological, moral and political proposals. By associating the ideas of the concrete psychology that encapsulates the existence of man-actor, Canguilhem reconciles (...) two series of arguments: a). the philosophy of life cannot do without an approach to human action; b). the presence of human action becomes inseparable from the assumptions that debate its existence between the singularity of its productions, and the apprehension that can be made of it by means of the universals that are proposed by science. In the remainder of this article, we will disarm an important motivation for epistemic contextualism and interest-relative invariantism. We will accomplish this by presenting a stringent test of whether there is a stakes effect on ordinary knowledge ascription. Having shown that, even on a stringent way of testing, stakes fail to impact ordinary knowledge ascription, we will conclude that we should take another look at classical invariantism. Here is how we will proceed. Section 1 lays out some limitations of previous (...) research on stakes. Section 2 presents our study and concludes that there is little evidence for a substantial stakes effect. Section 3 responds to objections. The conclusion clears the way for classical invariantism. This article examines whether people share the Gettier intuition (viz. that someone who has a true justified belief that p may nonetheless fail to know that p) in 24 sites, located in 23 countries (counting Hong Kong as a distinct country) and across 17 languages. We also consider the possible influence of gender and personality on this intuition with a very large sample size. Philosophers have long debated whether, if determinism is true, we should hold people morally responsible for their actions since in a deterministic universe, people are arguably not the ultimate source of their actions nor could they have done otherwise if initial conditions and the laws of nature are held fixed. To reveal how non-philosophers ordinarily reason about the conditions for free will, we conducted a cross-cultural and cross-linguistic survey (N = 5,268) spanning twenty countries and sixteen languages. Overall, participants tended (...) to ascribe moral responsibility whether the perpetrator lacked sourcehood or alternate possibilities. However, for American, European, and Middle Eastern participants, being the ultimate source of one’s actions promoted perceptions of free will and control as well as ascriptions of blame and punishment. By contrast, being the source of one’s actions was not particularly salient to Asian participants. Finally, across cultures, participants exhibiting greater cognitive reflection were more likely to view free will as incompatible with causal determinism. We discuss these findings in light of documented cultural differences in the tendency toward dispositional versus situational attributions. (shrink)

Since at least Hume and Kant, philosophers working on the nature of aesthetic judgment have generally agreed that common sense does not treat aesthetic judgments in the same way as typical expressions of subjective preferences—rather, it endows them with intersubjective validity, the property of being right or wrong regardless of disagreement. Moreover, this apparent intersubjective validity has been taken to constitute one of the main explananda for philosophical accounts of aesthetic judgment. But is it really the case that most people (...) spontaneously treat aesthetic judgments as having intersubjective validity? In this paper, we report the results of a cross‐cultural study with over 2,000 respondents spanning 19 countries. Despite significant geographical variations, these results suggest that most people do not treat their own aesthetic judgments as having intersubjective validity. We conclude by discussing the implications of our findings for theories of aesthetic judgment and the purpose of aesthetics in general. (shrink)

Does the Ship of Theseus present a genuine puzzle about persistence due to conflicting intuitions based on “continuity of form” and “continuity of matter” pulling in opposite directions? Philosophers are divided. Some claim that it presents a genuine puzzle but disagree over whether there is a solution. Others claim that there is no puzzle at all since the case has an obvious solution. To assess these proposals, we conducted a cross-cultural study involving nearly 3,000 people across twenty-two countries, speaking eighteen (...) different languages. Our results speak against the proposal that there is no puzzle at all and against the proposal that there is a puzzle but one that has no solution. Our results suggest that there are two criteria—“continuity of form” and “continuity of matter”— that constitute our concept of persistence and these two criteria receive different weightings in settling matters concerning persistence. Is behavioral integration a necessary feature of belief in folk psychology? Our data from over 5,000 people across 26 samples, spanning 22 countries suggests that it is not. Given the surprising cross-cultural robustness of our findings, we argue that the types of evidence for the ascription of a belief are, at least in some circumstances, lexicographically ordered: assertions are first taken into account, and when an agent sincerely asserts that p, nonlinguistic behavioral evidence is disregarded. This article explores the philosophy of Alain Badiou from the vantage point of the concepts of the localization, delocalization, and relocalization of the void as thematized through literary arts, religion, emancipatory politics, and the subject of psychoanalysis. In short, these moments around the void characterize the processes through which truth is processed and seen through their full realization by a philosophical engagement across the various conditions in which these truths occur. The localization of a void is the naming of an (...) indiscernible element that is incommensurable to the rubric of constructible knowledge, sense and meaning which could saturate the space of truth. Thus, the naming that localizes the void acts as a subtraction of the invariant in the variance of situation such that across various points in space and time, we are still able to subtract the universal as the invariant not just as the fidelity to the localized truth but also as the resurrection of truth upon its relocalization at a different place and a different time. At its core, this article is concerned with truth, why truth is persistent, and why we have to struggle to articulate the truth that we are trying to be faithful to again and again with each instance that truth risks being covered-over and obscured. BackgroundStudies and meta-analyses found individual, meso and micro-social factors that are associated with individual well-being, as well as a positive socio-emotional climate or collective well-being.AimThis article simultaneously studies and examines these factors of well-being.MethodWell-Being is measured as a dependent variable at the individual and collective level, as well as the predictors, in three cross-sectional and one longitudinal studies. Education and social intervention workers from Chile, Spain and Uruguay participate; a subsample of educators from the south central Chile and from Chile, (...) Uruguay and Spain ; workers from organizations in Latin America and Southern Europe, military cadets from Argentina ; and teams from Spanish companies.ResultsIndividual and collective well-being indicators were related, suggesting that the emotional climate as a context improves personal well-being. Individual factors, psychosocial factors were positively associated with personal well-being in education and social intervention context. Organizational dynamic or transformational culture is directly and indirectly associated with individual well-being through previously described psychosocial factors. Group processes such as internal communication and safe participation, task orientation or climate of excellence as well as leadership style that reinforces participation and belonging, were positively associated with collective well-being in labor and military context and predict team work socio-emotional climate in a longitudinal study- but were unrelated to individual well-being. Transformational leadership plays a mediating role between functional factors and social-emotional climate in work teams. Organizational role autonomy, functional organizational leadership, integration and resources were associated with collective well-being in organizations. Organizational leadership moderates the relationship between task orientation and collective well-being in military context.ConclusionIndividual and microsocial factors influence personal well-being. Meso level factors favorable to well-being through processes which reinforce social belonging, influence directly collective well-being and indirectly personal well-being. Leadership that reinforces participation and belonging play a central role for emotional climate. Stress and emotional climate playing an important pivotal role for psychological well-being. La investigación en el campo de las actitudes desarrolladas por parte de los agentes educativos se hace inexorablemente pertinente y necesaria para la construcción de una sociedad futura libre de conflictos innecesarios. En este estudio se han analizado las actitudes familiares mediante entrevista semiestructurada. Se realizó un análisis cualitativo y cuantitativo, obteniendo el perfil sobre pensamiento en torno (...) a la diversidad cultural de progenitores e hijos. El grado de concordancia de dichas actitudes queda reflejado en el análisis de los resultados, apreciando desconocimiento de grupos culturalmente diversos, ventajas de enriquecimiento personal, convicción sobre la necesidad de integrar tanto a los estudiantes como a sus familias, preparación del profesorado y fomento de unas relaciones óptimas entre alumnos, docentes y familias. No obstante, existen divergencias en la función de la escuela con relación a las conductas, creencias, tradiciones y dificultades, y a la formación de los docentes para superarlas y para el tratamiento de la diversidad. In this extraordinary contribution to Nietzsche studies, Robert Alejandro offers an original interpretation of Friedrich Nietzsche's philosophy viewed as a complete whole. Alejandro painstakingly traces the different ways in which Nietzsche reconfigured and shifted his analyses of morality and of the human condition, until he was content with the final result: nothing was dispensable; everything was necessary. This is a philosophy of reconciliation--hardly nihilism--and it is a perspective that is not adequately addressed elsewhere in the literature on Nietzsche. (...) “X-Firsters” hold that there is some normative feature that is fundamental to all others (and, often, that there’s some normative feature that is the “mark of the normative”: all other normative properties have it, and are normative in virtue of having it). This view is taken as a starting point in the debate about which X is “on first.” Little has been said about whether or why we should be X-Firsters, or what we should think about normativity if we aren’t (...) X-Firsters. Hence the chapter’s two main goals. First, to provide a simple argument that one shouldn’t be an X-Firster about the normative domain, which starts with the observation that analogous views have dubious merits in analogous domains. Second, to offer an alternative view—taking normativity to be a determinable explained in terms of its determinates—that offers an interesting way to think about the structure and unity of normativity. Supporters of open borders sometimes argue that the state has no pro tanto right to restrict immigration, because such a right would also entail a right to exclude existing citizens for whatever reasons justify excluding immigrants. These arguments can be defeated by suggesting that people have a right to stay put. I present a new form of the exclusion argument against closed borders which escapes this “right to stay put” reply. I do this by describing a kind of exclusion that (...) has not been discussed in depth, which I call “territorial exclusion.” Territorial exclusion is the process according to which the group that wishes to exclude current citizens secedes from the territory in which those citizens reside. I argue that the wrongness of territorial exclusion explains why there is no pro tanto right for a state to exclude immigrants, because otherwise there would be a pro tanto right for the state to kick people out by seceding from the territory they inhabit. Because kicking people out like this is typically wrong, borders cannot be closed. (shrink)

Motion—and, in particular, local motion or change in location—plays a central role in Kenelm Digby’s natural philosophy and in his arguments for the immateriality of the soul. Despite this, Digby’s account of what motion consists in has yet to receive much scholarly attention. In this paper, I advance a novel interpretation of Digby on motion. According to it, Digby holds that for a body to move is for it to divide from and unify with other bodies. This is a view (...) of motion—as change in relations of parthood—that Alison Peterman attributes to Digby’s contemporary and acquaintance, Margaret Cavendish. Having shown that Digby’s presentation of the view predates Cavendish’s by more than a decade, I make a case that Digby’s work influenced Cavendish’s on this topic. In developing and defending my reading, I consider to what extent the Digbean account of motion and the arguments for it accord with the ideals of the mechanical philosophy emerging in the early modern period. The potential to collect brain data more directly, with higher resolution, and in greater amounts has heightened worries about mental and brain privacy. In order to manage the risks to individuals posed by these privacy challenges, some have suggested codifying new privacy rights, including a right to “mental privacy.” In this paper, we consider these arguments and conclude that while neurotechnologies do raise significant privacy concerns, such concerns are—at least for now—no different from those raised by other well-understood data collection (...) technologies, such as gene sequencing tools and online surveillance. To better understand the privacy stakes of brain data, we suggest the use of a conceptual framework from information ethics, Helen Nissenbaum’s “contextual integrity” theory. To illustrate the importance of context, we examine neurotechnologies and the information flows they produce in three familiar contexts—healthcare and medical research, criminal justice, and consumer marketing. We argue that by emphasizing what is distinct about brain privacy issues, rather than what they share with other data privacy concerns, risks weakening broader efforts to enact more robust privacy law and policy. I ask you to X. You now have a reason to X. My request gave you a reason. How? One unpopular theory is the epistemic account, according to which requests do not create any new reasons but instead simply reveal information. For instance, my request that you X reveals that I desire that you X, and my desire gives you a reason to X. Peter Schaber has recently attacked both the epistemic account and other theories of the reason-giving force of (...) requests. Schaber defends a new theory of the reason-giving force of requests according to which request give reasons because it is valuable for requesters and requestees that requests have this power. In this paper I argue that Schaber's attack on the epistemic account fails, and that his own theory ought to be rejected because it faces compelling objections. (shrink)

Plato's dialogues frequently criticize traditional Greek myth, yet Plato also integrates myth with his writing. Daniel S. Werner confronts this paradox through an in-depth analysis of the Phaedrus, Plato's most mythical dialogue. Werner argues that the myths of the Phaedrus serve several complex functions: they bring nonphilosophers into the philosophical life; they offer a starting point for philosophical inquiry; they unify the dialogue as a literary and dramatic whole; they draw attention to the limits of language and the limits (...) of knowledge; and they allow Plato to co-opt cultural authority as a way of defining and legitimating the practice of philosophy. Platonic myth, as a species of traditional tale, is thus both distinct from philosophical dialectic and similar to it. Ultimately, the most powerful effect of Platonic myth is the way in which it leads readers to participate in Plato's dialogues and to engage in a process of self-examination. (shrink)
